Terms of Service
Effective November 4, 2026
Acceptance
These Terms of Service are a contract between you and Freeway, LLC, an Arizona limited liability company (“Freeway,” “we,” “us”). They govern your access to and use of Freeway’s websites, applications, and related services (the “Services”).
Creating an account is your acceptance of these Terms and of the Privacy Policy. The same acceptance applies when you finish an invitation and create an account. If you use the Services without an account, you agree to these Terms by using them. If you do not agree, do not create an account and do not use the Services.
Who Freeway is
Freeway operates a platform for the Phoenix startup ecosystem. People and companies use it to be introduced, to publish roles, to find roles, and to take part in the community around those roles.
Freeway identifies and introduces prospective candidates. Freeway does not interview candidates, screen them, verify credentials, conduct background or reference checks, or perform human-resources or employment functions. Freeway is not an employment agency, a search firm, a recruiter of record, a professional employer organization, or a staffing agency. A match, a score, or an introduction is a tool for the people involved. It is not a hiring recommendation, an endorsement, or a promise that anyone will be hired.
Who these Terms cover
These Terms cover every account on the Services:
- Candidates, who join to be considered for roles.
- Employers, meaning the company representatives who use the Services for a company.
- Ecosystem partners, who keep an organization presence and may also turn on job seeking.
- Administrators, who operate the platform.
If a section names one role, it applies to that role. The rest of these Terms apply to everyone.
Eligibility and authority
You must be at least 18 years old to create an account or use the Services. You must provide information that is true and keep it current.
If you create an account or act for a company or other organization, you represent that you have authority to bind that organization to these Terms for its use of the platform. A separate written agreement may still be required before that organization can use matching. The section on fees and the separate employer agreement describes it.
Your account
You are responsible for the activity on your account and for keeping your sign-in credentials confidential. Tell us promptly at the contact below if you believe someone else is using your account.
An account is for one person. A company may have more than one representative, and each representative has their own account. Do not share an account, and do not create an account for someone else unless you are inviting them through the product and they accept these Terms themselves.
What you may do
Candidates may build a profile, provide a résumé, receive matches, signal interest in a role, use the network, take part in events, and request or receive recommendations.
Employers may maintain a company profile, publish job postings, and use the tools we make available for those postings. A company sees a candidate’s matching profile when that candidate signals interest in one of the company’s roles. The company does not receive that profile before then.
Ecosystem partners may maintain an organization presence. If a partner turns on job seeking, the candidate portions of these Terms apply to that use.
Administrators may invite users, operate the product, and record that a company has entered the separate employer agreement. An administrator is bound by these Terms in that work.
Artificial intelligence
We use artificial intelligence to perform specific tasks on content you submit or that we prepare from it. Today those tasks are: parsing a résumé; summarizing personal experience and work history; parsing a job description; creating a job posting; and matching jobs to job seekers, including judging how a job fits a job seeker.
We send the content needed for a task to our provider, Anthropic, so the provider can perform that task. We do not use your content to train our own models. Our agreement with Anthropic does not permit Anthropic to train its models on content we send through its API. The Privacy Policy describes this processing in more detail.
AI output can be inaccurate, incomplete, or unsuitable for your purpose. Review it before you rely on it, publish it, or share it. You are responsible for the job postings, profile information, and other material you submit or publish, including material a model drafted for you. A match score is an aid to the people making their own decisions. It is not a hiring decision, a credential check, or a guarantee of fit.
Your content and who can see it
You keep ownership of the content you submit, including your résumé, profile, job postings, recommendations, and messages. You give Freeway a non-exclusive license to host, store, reproduce, modify (including by parsing and summarizing), display, and otherwise use that content as needed to operate the Services, to perform the tasks in these Terms, and to show it to the people the product is built to show it to.
You represent that you have the rights needed to submit the content, and that submitting it does not violate someone else’s rights or a law.
- A company sees your candidate profile, including experience drawn from your résumé, when you signal interest in one of that company’s roles.
- If you turn on a public networking profile, members who can browse the network, including company representatives, can see the public fields you chose to show, such as your name, title, location, and bio.
- A recommendation you request may be written by the person you ask and shown with your profile.
- Other representatives of your company can see the company information and postings on the company account.
- Administrators can see information as needed to operate the Services.
Acceptable use
Use the Services only for lawful purposes and in line with these Terms. You will not:
- Provide false credentials, a false identity, or a false affiliation.
- Impersonate another person or organization.
- Submit someone else’s personal information unless you have the right to do so.
- Use the Services to discriminate unlawfully.
- Scrape, harvest, or bulk-collect data from the Services, or attempt to reverse engineer them, except where a law forbids this restriction.
- Interfere with the security or operation of the Services, or probe them without permission.
- Treat AI output as verified fact.
- Circumvent a limit in the product, including the requirement that company matching wait for the separate employer agreement.
No employment relationship and no guarantee
Freeway is not your employer, your employee, or your agent. Nothing in these Terms creates a partnership, joint venture, franchise, or fiduciary relationship between you and Freeway, or between you and another user. Neither you nor Freeway has authority to bind the other.
We do not guarantee that you will receive a match, an introduction, an interview, or a hire, or that any candidate will be suitable, available, or interested. Whether to engage someone is the company’s own decision. Whether to signal interest or accept a conversation is the candidate’s own decision. Success depends on those decisions.
Disputes between users
You are responsible for your dealings with other users, including hiring, employment, contracting, rejection, and termination. Freeway is not a party to those dealings. You release Freeway from claims arising out of a dispute you have with another user, to the extent the law allows that release.
Fees and the separate employer agreement
Creating an account and using the platform during the private beta does not require a subscription fee. If we later charge for a platform feature, we will tell you before you incur the charge.
Introductions and any fee for them are governed by a separate written agreement between Freeway and the company, when that company has entered one. These Terms do not set that fee, and they do not replace that agreement. Accepting these Terms by creating an account does not record the company’s agreement and does not turn company matching on. Matching for a company stays off until an administrator records that the company has agreed to the separate terms.
If a separate written agreement conflicts with these Terms on the subject of that agreement, the separate agreement controls for that subject. These Terms still govern use of the platform.
Privacy
The Privacy Policy is part of these Terms. It describes what we collect, how we use it, and the choices you have. Creating an account is acceptance of the Privacy Policy as well as these Terms.
Freeway’s intellectual property
Freeway and its licensors own the Services, including the software, design, matching methods, and the Freeway name and marks. These Terms give you a limited, revocable, non-exclusive right to use the Services as they are offered. They do not give you any ownership of the Services. Do not copy the Services, use the marks, or remove proprietary notices except as the product itself allows.
If you send us feedback, we may use it without obligation to you.
Disclaimers, liability, and indemnity
The Services are provided “as is” and “as available.” To the fullest extent Arizona law allows, Freeway disclaims warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Services will be uninterrupted, secure, or error-free, or that AI output or a match will be accurate or suitable.
To the fullest extent Arizona law allows, Freeway will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or opportunities, whether or not we knew they were possible. Freeway’s total liability for claims arising out of the platform, other than a claim under a separate written agreement, is limited to the greater of the amounts you paid Freeway for the platform in the twelve months before the claim, or one hundred U.S. dollars.
These limits do not apply to liability that cannot be limited under applicable law, or to a party’s fraud or willful misconduct. A separate written agreement’s liability terms control for claims under that agreement.
You will indemnify Freeway and its members, managers, employees, and agents against third-party claims, and the resulting damages and reasonable attorneys’ fees, to the extent they arise out of content you submit, your use of the Services in violation of these Terms or the law, or, if you act for an employer, that employer’s hiring, employment, supervision, or termination decisions. This indemnity does not apply to Freeway’s own fraud or willful misconduct. We will give you prompt notice of a claim and reasonable cooperation.
Ending an account
You may stop using the Services at any time. To ask us to delete your account and the personal information we hold, email the contact below. There is no self-serve deletion control in the product today.
We may suspend or close an account, or remove content, if you breach these Terms, if we need to do so to protect the Services or other people, or if the law requires it. We will tell you when we reasonably can.
Ending access does not erase obligations that have already accrued. The sections on your content (for the wind-down of the Services), acceptable use, disputes between users, the separate employer agreement, intellectual property, disclaimers and liability, indemnity, governing law, and general terms survive.
Changes
We may update these Terms. We will post the new version on this page and change the effective date. If a change is material, we will also give notice by email or in the product when we have a way to reach you. Using the Services after the new effective date is acceptance of the updated Terms. If you do not agree, stop using the Services and ask us to delete your account.
Governing law and venue
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. The state and federal courts located in Maricopa County, Arizona have exclusive jurisdiction and venue over any dispute arising out of or relating to these Terms or the Services. You and Freeway irrevocably submit to that jurisdiction and waive any objection based on inconvenient forum.
General
These Terms and the Privacy Policy are the entire agreement between you and Freeway about use of the platform. They supersede earlier understandings on that subject. A separate written agreement remains in force for its own subject, as the fees section describes.
If a provision is held invalid, the rest stays in effect. A failure or delay in enforcing a right is not a waiver. These Terms do not create any third-party beneficiary. You may not assign these Terms without our prior written consent. We may assign them to an affiliate or to a successor in a merger, reorganization, or sale of the business. Headings are for convenience. “Including” means “including without limitation.” Notices to you may be sent to the email on your account. Notices to Freeway must be sent to the contact below.
